Нормативизм и юридический позитивизм в исследовании «Локальных нормативных правовых актов»: пороки теорий

Abstract

The article shows the normativism and legal positivism ideas influence upon the doctrine of internal statutory acts in Russian jurisprudence. Defectiveness of the interior rule-making obligatory state authorizing theory in the modern political, legal and economic conditions is substantiated. The author concludes that there is a need to use the achievements of the sociological school of law in the analyzing phenomenon reassessment process.

Прослеживается влияние идей нормативизма и юридического позитивизма на учение о локальных нормативных правовых актах в отечественной юриспруденции. Обосновывается дефектность теории государственного санкционирования локального нормотворчества в современных политико-правовых и экономических условиях. Делается вывод о необходимости использования в процессе переосмысления исследуемого феномена достижений социологической школы права.
