Судебная реформа: некоторые оценки и предложения

Abstract

Evaluating some results of permanent ongoing judicial reform, the author accuses the legislator in the absence of proper accounting of the essence of the reformed phenomena. It is proposed to proceed from the understanding of the unity of the process (criminal, civil, arbitration, administrative), which is very important for consolidation of institutions that do not depend on the type of process, nor on its kind (most of the principles of judicial proceedings, law of evidence, review stages). To ensure the unity of the process the author suggests drafting as a federal constitutional law Fundamentals of the judicial proceedings legislation, based on the updated provisions of the P. 3 of the Art. 128 of the Constitution of the Russian Federation. She also supports the idea of creating a unified Code of Civil Procedure and negates the need for the adoption of the Code of Administrative Procedure, which has passed its first reading in the State Duma.

Оценивая некоторые итоги перманентно продолжающейся судебной реформы, автор статьи упрекает законодателя в отсутствии должного учета сущности реформируемых явлений. Предлагается исходить из понимания единства процесса (уголовного, гражданского, арбитражного, административного), что весьма значимо для закрепления институтов, не зависящих ни от типа процесса, ни от его вида (большинство принципов судопроизводства, доказательственное право, стадии пересмотра). Для обеспечения единства процесса предлагается разработать в виде федерального конституционного закона Основы законодательства о судопроизводстве, опираясь на обновленные положения ч. 3 ст. 128 Конституции РФ. Также поддерживается идея создания объединенного Кодекса гражданского судопроизводства и отрицается необходимость принятия Кодекса административного судопроизводства, прошедшего первое чтение в Государственной Думе РФ.
