Abstract

В статье авторы рассматривают некоторые правовые проблемы, влияющие на определение юрисдикции органов международного арбитража в отношении международных инвестиционных споров с участием частного инвестора. Обращается внимание на необходимость анализа ряда обстоятельств при планировании осуществления инвестиционной деятельности на территории иностранного государства.

In this article the authors consider some legal issues that influence on determination of jurisdiction of international arbitration tribunals on international investment disputes involving private investors. Attention is paid to the necessity to analyze a number of factors in the course of planning of investment activity in the territory of a foreign state.
