Диспозитивность и применение последствий недействительности сделки

Abstract

В данной статье исследуется вопрос о соотношении принципа диспозитивности при использовании последствий недействительности сделки. Определяется понятие принципа диспозитивности, какие возможности он предоставляет. За результатами проведенного исследования предлагается осуществить усовершенствование действующего гражданского законодательства с целью оптимизации обращений в суд с соответствующими требованиями с осуществлением эффективной судебной защиты нарушенного или оспоренного права. Подчеркивается, что применение последствий недействительности сделки неразрывно связано с обращением соответствующего лица в суд с иском о защите гражданских прав, в частности, в части применения последствий ничтожной сделки и без предъявления соответствующего требования судами по собственной инициативе последствия недействительности ничтожной сделки применяться не должны, как такие, что противоречат принципу диспозитивности судебного процесса.

The article analyses relationship between the principles of optionality using the consequences of invalid transactions. The author defines a concept of the principle of optionality, what opportunities it provides. The results of the study are proposed for improvement of the existing civil law in order to optimize references to the court with the relevant requirements to the implementation of effective judicial protection of the violated or disputed rights. The author underlines that using of the consequences of invalid transactions is inextricably linked with treatment of the person concerned in court for civil rights, in particular with regard to application of the consequences of a void transaction and without the relevant request by the courts on their own initiative consequences of a void transaction should not be used as such that contradict the principle of discretionary trial.
