Противоречия в механизме уголовно-правовой охраны собственности от мошеннических посягательств, совершаемых в сфере предпринимательской деятельности

Abstract

Дополнение Уголовного кодекса России новыми составами мошенничества породило дискуссию об обоснованности этого законодательного решения. В числе вновь появившихся норм особое место занимает статья 159 4 УК РФ, предусматривающая ответственность за мошенничество в сфере предпринимательской деятельности, которая имеет существенные различия как с иными «специальными» составами мошенничества, так и с «материнским». Научная общественность и представители правоприменительных органов неоднозначно оценили указанную законодательную новеллу, которая внесла дисбаланс в сложившуюся следственно-судебную практику. В статье исследуются элементы состава мошенничества в сфере предпринимательской деятельности, особенности их влияния на процесс квалификации, соотношение рассматриваемого состава со смежными преступными деяниями.

The addition of the Russian Criminal code new types of fraud, has generated a debate about the validity of this legislative solution. Among the new rules is art. 1594 of the Russian Criminal code provides the liability for fraud in the sphere of entrepreneurial activity, which has significant differences as with other «special» crimes of fraud as «parent». The scientific community and representatives of law enforcement agencies ambiguously appreciated specified legislative novel that made the imbalance in the current investigative and judicial practice. The elements of fraud in the sphere of entrepreneurial activity, the particularities of their impact on the qualification process, the ratio of the considered composition with related criminal acts are analyzed in the article.
