К вопросу о допустимости применения полиграфа для получения показаний в судебном следствии

Abstract

The article examines the prospect of using the polygraph in the court proceedings. There are examples of the use of the polygraph during judicial interrogations. The author believes that in the course of judicial questioning the use of lie detector is not allowed because there is a threat to individual rights and freedom of the evaluation of the evidence by the judge on their own beliefs. The author sees signs of degradation of the legal culture in an attempt to legitimize the use of the polygraph in the judicial and investigative practice, argues that the polygraph can only be used in operational and investigative activities.

В статье анализируется перспектива использования в судебном следствии полиграфа. Приводятся примеры использования полиграфа при проведении судебных допросов. Автор считает, что в ходе судебного допроса применение детектора лжи недопустимо, поскольку возникает угроза правам личности и свободе оценке доказательств судьей по своему внутреннему убеждению. Он видит признаки деградации правовой культуры в попытках узаконить использование полиграфа в судебно-следственной практике. Им приводятся доводы в пользу того, что полиграф может использоваться только в оперативно-розыскной деятельности.
