Признание недействительными несостоявшихся торгов как способ защиты гражданских прав

Abstract

For many years, the Russian arbitration court practice rested on the postulate that the failed auction cannot be acknowledged as invalid, and in 2010 the Supreme Arbitration Court of the Russian Federation replaced the postulate with an antipodal one. The article is devoted to the analysis of this replacement. It is shown that invalidating the failed auction causes legal and economical problems for the bona fide party of the contract concluded, and the rights of the interested parties are only formally restored. The necessity is justified of the development of a mechanism of the effective participants' rights protection in relations caused by announcing the auction failed.

Многие годы российская арбитражная практика основывалась на постулате о том, что несостоявшиеся торги нельзя признать недействительными, который в 2010 г. был изменен ВАС РФ на диаметрально противоположный. Статья посвящена анализу данного изменения, в частности показано, что признание несостоявшихся торгов недействительными создает юридические и экономические проблемы для добросовестной стороны заключенного на торгах договора, а права заинтересованных лиц восстанавливает лишь формально. Обоснована необходимость нормативной разработки механизма результативной защиты прав всех участников отношений, возникающих при объявлении торгов несостоявшимися.
