Противоправная деятельность по обналичиванию безналичных денежных средств

Abstract

В статье предлагается конкретный механизм по совершенствованию правового регулирования выявления незаконного оборота безналичных денежных средств. На основании действующего гражданского и уголовного законодательства автором выявлен ряд проблем гражданско-правовой и уголовно-правовой классификации правонарушений и преступлений в сфере незаконной банковской деятельности. Проводится научный анализ таких понятий, как законная и незаконная банковская деятельность, перечисляются субъекты противоправных деяний, характеризующих данный институт.

The paper proposes a specific mechanism for the improvement of legal regulation on the identification of illicit trafficking of non-cash funds. On the basis of the current civil and criminal legislation the author revealed a number of issues of civil law and criminal law classification of offenses and crimes related to illegal banking activity. Conducted scientific analysis of such concepts as legal and illegal banking activities, listed wrongful acts of the subjects that characterize this institution.
