Abstract

The article contains the analysis of norms of the criminal code concerning the assignment of punishment by accumulation of crimes and accumulation of sentences. In addition, the basic provisions of the procedures for determining the terms of punishment in case of partial or complete assimilation of punishments on set of crimes and accumulation of sentences. Also identified some gaps in the legislation the regulation of the order of summation of punishments in the form of a fine and imprisonment.

В статье приведен анализ норм Уголовного кодекса, касающихся назначения наказаний по совокупности преступлений и совокупности приговоров. Кроме того, приведены основные положения порядка определения сроков наказаний при частичном или полном сложении наказаний по совокупности преступлений и совокупности приговоров. Также обозначены отдельные пробелы взаконодательном регулировании порядка сложения наказаний в виде штрафа и лишения свободы.
