Article contains the concept analysis «essence of the obligation». In it approaches to concept definition are considered, cases of use of the given term in the works mentioning questions of change of obligations are investigated. The essence of the obligation in work reveals through «causa» in causal obligations and through the form and obligatory requisites in abstract obligations. Value of preservation of essence of obligations is shown at qualification of consequences of change of structure and elements of the last.

Статья содержит анализ понятия «сущность обязательства». В ней рассмотрены подходы к определению понятия, исследованы случаи использования данного термина в работах, затрагивающих вопросы изменения обязательств. Сущность обязательства в работе раскрывается через causa в каузальных обязательствах и через форму и обязательные реквизиты в абстрактных обязательствах. Показано значение сохранения сущности обязательств при квалификации последствий изменения структуры и элементов последних.
