Abstract

В статье исследуется понятие «средства прокурорского надзора», обосновывается различие между понятиями полномочий, средств и методов прокурорского надзора, производится дифференциация на правовые и организационно-методические средства, предлагаются способы повышения эффективности средств прокурорского надзора в оперативно-розыскной деятельности. Выделение организационно-методических средств из числа правовых средств представляет немалую практическую ценность и имеет существенное прикладное значение, поскольку на практике применение исключительно правовых средств по ряду причин не всегда способно принести желаемый результат. На практике отмечается снижение эффективности применения правовых средств в сфере прокурорского надзора за исполнением законов в оперативно-розыскной деятельности. В целях разрешения указанной проблемы, связанной с кризисом использования правовых средств, для эффективной реализации всего объема своих полномочий прокуроры используют организационно-методические средства, перечень которых законодательно не ограничен и зависит от инициативы и творчества прокуроров. Для совершенствования правовых средств прокурорского надзора за исполнением законов в оперативно-розыскной деятельности необходимо законодательное закрепление возможности применения таких средств не только по факту уже принятых соответствующих судебных решений или осуществленной оперативно-розыскной деятельности, но и в период принятия решений о ее осуществлении.

The article concerns the definition of «means of prosecutor supervision», substantiating the differences between the terms «competence», «means» and «methods» of prosecutor supervision, differentiating between legal and organizational-methodological means, the author makes propositions on greater efficiency of the prosecutor supervision in operative investigation activity. Distinguishing organizational legal means among the legal means is of great practical importance, since application of solely legal means on some matters may not lead to optimum results. The author notes the lower efficiency of application of legal means in the sphere of prosecutor supervision over the implementation of laws in the operative investigation activities. In order to resolve the said problem regarding the crisis of application of legal means for the efficient implementation of their competence the prosecutors apply organizational methodological means, and their list is not legislatively limited, depending on initiative and creativity of prosecutors. In order to improve the legal means of prosecutor supervision over the implementation of laws in the operative investigation activities, there is need for the legislative provisions for the possibility to apply these means at the time when decisions on the measures are being made, as well as after the relevant judicial decisions or operative investigation activities have already taken place.
