Правовые основы поисковой деятельности подразделений, осуществляющих оперативно-розыскную деятельность

Abstract

В данной научной статье авторы рассматривают правовые организационные и тактические вопросы оперативно-розыскной деятельности в ходе осуществления поисковой деятельности. Авторы сравнивают отдельные положения и нормы Конституции Российской Федерации, уголовного права, уголовно-процессуального права, Федеральных Законов, регламентирующих оперативно-розыскную деятельность, в частности поисковую деятельность, некоторые источники получения информации, например, конфиденциальные. В частности, авторы рассматривают правовую основу органов внутренних дел в борьбе с преступностью как научно-обоснованную систему правовых норм, содержащихся в законах и подзаконных нормативных актах, создающих правовые предпосылки, а также условия и порядок для осуществления оперативно-розыскных мероприятий, либо непосредственно регламентирующих правовые организационные и тактические вопросы применения оперативно-розыскных сил, средств, методов и форм в борьбе с преступностью. Таким образом, авторы считают, что поисковая деятельность подразделений, осуществляющих оперативно-розыскную деятельность в полиции, являясь организационно-тактической формой (направлением, составной частью), оперативно-розыскной деятельности органов внутренних дел в целом, имеет единую правовую основу, что и оперативно-розыскная деятельность в целом

The authors of the article consider legal organizational and tactical issues of operational investigative activities in the course of search. The authors compare some items and norms of Russian Constitution, Criminal Law, Criminal Procedure Law, Federal Laws governing the operational-search activity, in particular search activity, some sources of information, such as confidential. In particular, the authors examine the legal basis of the internal affairs agencies in the fight against crime as a science-based system of legal norms contained in the laws and by-laws that create the legal preconditions, as well as the conditions and procedure for carrying out operative search actions, either directly regulating the legal organizational and tactical questions of application of operational investigative forces, means, methods and forms in the fight against crime. Thus, the authors believe that the search activities of the units engaged in operational investigative activities of the police, as an organizational and tactical form (or part of) the operational-search activity of law enforcement bodies as a whole, it has a single legal framework that operational search activity in general
