Компромисс в праве сквозь призму философии всеединства

Abstract

In the paper is considered the theme of compromise on law as a philosophic problem. According to the author, understanding compromise on law depends on the way of substantiating law. here is suggested the topical attempt to analyze the theme of compromise on law resting on a resource of the influential line of Russian philosophy all-unity philosophy. This allows to justify the ontological status of law with natural law approach and define the place of compromise as a positive part of law reality.

В статье рассматривается тема компромисса в праве как философско-правовая проблема. По мнению автора, понимание компромисса в праве зависит от способа обоснования права. Актуальной выступает попытка проанализировать тему компромисса в праве, опираясь на ресурс влиятельного направления отечественной философии философии всеединства. Это позволяет обосновать онтологический статус права в русле естественно-правового подхода и обозначить место компромисса в позитивной части правовой реальности.
