Abstract

Статья посвящена проблеме несовпадения теоретического и практического подходов в определении предмета преступления, который не имеет материального представления, и необходимости введения в теорию уголовного права понятия «виртуальный предмет преступления». Фактически существующий виртуальный предмет электронные данные, в том числе компьютерная информация, изображения, схемы, алгоритмы и т.д., на сегодняшний день юридически не может приниматься как предмет преступления и использоваться в качестве доказательств, поскольку теоретическая наука в качестве предмета преступления признает только вещи материального мира.
