Банкротство транснациональных компаний и российское право

Abstract

Ежегодный рост транснациональных корпораций способствует увеличению числа случаев возбуждения судебных процедур по признанию части таких субъектов неплатежеспособными должниками. В статье рассматривается ситуация с компанией «ЮКОС», решение по делу которой принималось с применением как американского, так и российского права. Предлагаются меры по сближению отечественного и европейского законодательства, что способствовало бы укреплению торгово-экономических связей между российскими и иностранными хозяйствующими субъектами.

The annual growth of multinational corporations increases the number of court cases for the recognition of part of such entities as insolvent debtors. The article discusses the situation with the Yukos Company, the decision on whose case was taken according to both the U.S. and Russian law. The author proposes measures to ensure the convergence of the national and European legislation that would strengthen economic and trade relations between Russian and foreign business entities.
