УСТУПКА ПРАВА ТРЕБОВАНИЯ В ОРГАНИЗАЦИОННЫХ ОБЯЗАТЕЛЬСТВАХ: ОСНОВНЫЕ ТЕОРЕТИЧЕСКИЕ И ПРАКТИЧЕСКИЕ ПРОБЛЕМЫ

Abstract

Рассматривается уступка права требования как форма правопреемства в современном гражданском праве. Дается анализ понятия «тесная связь с личностью участника правоотношения», исследуются конститутивные признаки организационного обязательственного правоотношения и их влияние на возможность правопреемства в этих правоотношениях. Рассмотрены новеллы российского гражданского законодательства, а также правоприменительная практика.

The article examines the cession of legal claim as a form of succession in the modern civil law. The author analyzes the concept «close connection with a legal relationship participant», investigates constitutive features of the organized law of obligation and their influence on a possibility of a legal succession in the legal relationship.
