К вопросу о процедуре разрешения судом ходатайства о временном отстранении от должности

Abstract

Статья посвящена порядку возбуждения перед судом ходатайства о временном отстранении от должности, процедуре его разрешения су дом. Приведены примеры из судебной практики. Сделан вывод о том, что выявленные пробелы законодательства подлежат восполнению путем внесении изменений в ст. 114 УПК РФ, а также принятия соответствующего постановления Пленума Верховного Суда РФ.

The paper deals with the procedure of application of suspension. Examples from legal proceedings are given. The author comes to the conclusion of the necessity of making up legal loopholes by changes in the article 114 of the Legal Code of the Russian Federation and adoption of decree by the Plenum of Supreme Court of the Russian Federation.
