Abstract

Observance of a principle of legality by proceeding on criminal case frequently is interfered by erroneous interpretation of concepts of article 5 of the Criminally-proceeding code of the Russian Federation and «the working» norms of the Code connected with it. In such circumstances judgements are subject to cancellation on the basis of infringement of norms of the criminallyproceeding law.

Соблюдению принципа законности при производстве по уголовному делу зачастую препятствует ошибочная интерпретация понятий ст. 5 УПК РФ и связанных с ней «рабочих» норм кодекса. В таких обстоятельствах судебные решения подлежат отмене по основанию нарушения норм уголовно-процессуального закона.
