Досмотр транспортного средства как самостоятельная мера обеспечения производства по делу об административном правонарушении

Abstract

Даная статья посвящена характеристике нормативного закрепления досмотра транспортного средства как самостоятельной меры обеспечения производства по делу об административном правонарушении в сравнении с осмотром транспортного средства, исходя из существующей в правоприменительной практике особенности толкования этих понятий. В результате проведенного в статье исследования автором внесено предложение по оптимизации нормативного регулирования досмотра транспортного средства.

The article describes legal regulations of the vehicle examination as an independent support measure of the procedure on cases of administrative offence in comparison with the transport inspection according to the existing law enforcement practices and interpretation of the concept. In consequence of the undertaken research the author suggests to optimize the legal regulation of the vehicle examination procedure.
