Abstract

В статье раскрывается особенность реализации принципа разделения властей при построении органов государственной власти субъектов Российской Федерации. Путем проведения анализа действующей нормативной базы автор подтверждает, что закрепленный конституционно принцип приобретает особые черты в рамках системы современного государственного устройства субъектов Российской Федерации. Существующий ряд нерешенных вопросов в понятийном аппарате науки конституционного права, пробелы в законодательной базе приводят к искажению понимания принципа разделения властей исходя из его первоначального значения. Указанное, несомненно, должно учитываться при совершенствовании построения систем разделения властей субъектов Российской Федерации.

The article reveals the peculiarity of the principle of separation of powers in the construction of state power of subjects of the Russian Federation. Through analysis of the current regulatory framework, the author confirms that the constitutionally enshrined principle acquires special features within the modern state system of the Russian Federation. The current number of outstanding issues in the conceptual apparatus of science of constitutional law, gaps in legislation distorts understanding of the principle of separation of powers in terms of its original value. The above should certainly be taken into account in improving the construction of systems of separation of powers of the Russian Federation.
