Королевская (императорская) власть в Германии в х–хiii вв

Abstract

The paper is devoted to the general characteristics of monarchic power in Germany in the 10-13th centuries. It describes specific features of German monarchy, analyzes different aspects of king’s (emperor’s) power evolution. The author pays special attention to the legal position of the head of state and the order of succession. Besides, the paper outlines the limits of a monarch’s jurisdiction and his relations with other bodies of state power. Specifically, the author researches exclusive rights of the crown, for example, the right to use obligatory force in the form of administrative and judicial measures (Bannrecht — the right of Bann), king’s regalia (privileges primarily of ownership character, for example, exclusive right to mineral resources, construction and maintenance of burgs, etc.).

Статья посвящена общей характеристике монархической формы правления в Германии в Х–ХIII вв. В статье рассматриваются отличительные черты германской монархии, анализируются различные аспекты эволюции королевской (императорской) власти. Особое внимание уделено правовому положению главы государства, порядку замещения престола. Кроме того, определяется объем полномочий монарха и его взаимоотношения с другими государственными органами. В частности, исследуются исключительные права короны, например, право применять принудительную силу в виде административных и судебных мер (Bannrecht — право банна), королевские регалии (привилегии прежде всего имущественного характера, такие как исключительное право на полезные ископаемые, постройку и содержание бургов и т. д.).
