Методика проведения сравнительного историко-правового анализа

Abstract

Basic implementation phases of gnosiological potential of comparative historical and legal method are investigated in the article. The functional and heuristic directions of comparative historical and legal analysis are analysed. Content of historical, legal and comparative approaches on every stage of comparative study is disclosed here.

В статье исследуются основные этапы реализации гносеологического потенциала сравнительного историко-правового метода. Анализируются функциональное и эвристическое направления сравнительного историко-правового анализа. Раскрывается содержание исторического, правового и сравнительного подходов на каждой стадии сравнительного исследования
