Abstract

Рассматриваются теоретические и практические проблемы правового регулирования банкротства индивидуальных предпринимателей. Проведен критический анализ действующего российского конкурсного законодательства, а также практики его применения; обоснован комплекс предложений, направленных на совершенствование российского конкурсного законодательства о банкротстве индивидуального предпринимателя; определена правовая природа имущественно организационных ограничений, возникающих в ходе процедур, применяемых в деле о банкротстве индивидуального предпринимателя

This article discusses the theoretical and practical problems of legal regulation of the bankruptcy of the individual entrepreneurs. A critical analysis of existing Russian bankruptcy legislation and practice of its application, based on a set of proposals aimed at improving Russian bankruptcy bankruptcys legislation of individual entrepreneur, defined the legal nature of ownership-institutional constraints arising in the course of the procedures applied in the bankruptcy of an individual entrepreneur.
