
The international private law, regulating legal aspects of labor migration on the basis of an applicable law principle, faces necessity of differentiation of civil-law contracts and the labor contract. The author of article spends distinction of labor contracts and contracts rendering of services in their subjects (parties) and the maintenance which find the embodiment in the norms of the international private law regulating labor relations.
Международное частное право, регулируя правовые аспекты трудовой миграции на основе принципа применимого права, сталкивается с необходимостью разграничения гражданско-правовых договоров и трудового договора. Автор статьи проводит различие трудовых договоров и договоров возмездного оказания услуг по их субъектам (сторонам) и содержанию, которые находят свое воплощение в нормах международного частного права, регулирующих трудовые отношения.
