Особенности оперативно-разыскной характеристики преступлений, связанных с незаконной банковской деятельностью в современной России

Abstract

The article describes the peculiarities of operative and detective characteristics of crimes related to illegal banking activities in modern Russia providing for the effectiveness of economic security and anti-corruption units activities. Special attention is paid to the peculiarities in the qualification of acts under articles 171, 172, 187 of the Criminal Code of Russia committed in illegal banking activities. The article provides an in-depth analysis of the development of mechanisms of criminal acts related to illegal funds cashing in modern Russia. The necessity of the introduction of the scientific term «formally legitimate organization» is substantiated. Their classification is provided.

В статье раскрыты особенности оперативно-разыскной характеристики преступлений, связанных с незаконной банковской деятельностью в современной России, знание которых обеспечивает эффективность деятельности подразделений экономической безопасности и противодействия коррупции (ЭБиПК). Отдельное внимание уделено особенностям квалификации деяний по статьям 171, 172, 187 УК РФ, совершаемых в сфере незаконной банковской деятельности. Представлен глубокий анализ развития механизмов преступных действий по незаконному обналичиванию денежных средств в современной России. Обосновывается необходимость введения в научный оборот термина «формально-легитимная организация». Дается их классификация.
