Особенности государственной регистрации публичных сервитутов

Abstract

В статье рассматриваются особенности регистрации сервитутов как ограниченных вещных прав на объекты недвижимого имущества, порядок регистрации публичных сервитутов на земельный участок. Обосновывается вывод о том, что в случае принятия нормативного акта об установлении публичного сервитута и уклонения собственника объекта недвижимости от регистрации сервитута суд вправе по иску пользователей, указанных в акте об установлении сервитута, принять решение о регистрации.

The article discusses the features of the registration of easements as limited real rights to immovable property, considers the procedure for registration of public easements on land. The conclusion is that in the case of a regulation on the establishment of a public easement and evading the owner of the property from the registration of the easements the court may, at the suit of users specified in the act of easements, to take a decision on registration.
