Abstract

The article discusses the features of the excitation of criminal cases referred to the category of cases of private and private-public prosecution where the victim of a violent crime is a woman. The authors analyze the ratio of public and private interests in criminal cases in the order of part 4 art. 20 of Criminal Procedure Code, give the interpretation of regulatory statutes of art. 144 of Criminal Procedure Code of the Russian Federation from the standpoint of protection of the rights and legitimate interests of women victims of violent crime. The authors justify the need for a possible inspection of production, obtaining samples for comparative analysis, forensic examination with the participation of victims of crime only with their consent or the consent of their legal representatives.

В статье рассматриваются особенности возбуждения уголовных дел, отнесенных к категории дел частного и частно-публичного обвинения, когда жертвой насильственного преступления является женщина. Авторы анализируют соотношение публичных и частных интересов при возбуждении уголовных дел в порядке ч. 4 ст. 20 УПК РФ, дают толкование нормативных установлений ст. 144 УПК РФ с позиций защиты прав и законных интересов женщин жертв насильственных преступлений. Авторы обосновывают необходимость установления возможности производства освидетельствования, получения образцов для сравнительного исследования, проведения судебной экспертизы с участием жертв преступлений только при наличии их согласия либо согласия их законных представителей.
