Abstract

В работе исследуется основная линия развития отечественного законодательства и практики применения уголовно-правовых мер воспитательного характера, не являющихся уголовным наказанием, к несовершеннолетним правонарушителям в период с 1917 по 1958 год. Автор приходит к выводу о том, что ранний советский период характеризуется борьбой абстрактно-гуманистической идеи максимальной экономии репрессии и идеи усиления уголовной ответственности как основного способа быстро покончить с преступностью в среде несовершеннолетних. Именно в этот период впервые в отечественном законодательстве были систематизированы и наиболее детально разработаны уголовно-правовые принудительные меры, имеющие воспитательный (медико-педагогический) характер.

This work deals with the basic line of development of the domestic legislation and practice in applying criminally-legal measures of the educational character which are not criminal sanction to minor offenders during the period from 1917 to 1958. The author comes to a conclusion that the early Soviet period is characterised by struggle of abstract-humanistic idea of the maximum economy of reprisal and idea of strengthening criminal responsibility as the basic method quickly to finish criminality among minors. During this period for the first time in the domestic legislation have been systematised and most in details developed the criminally-legal forced measures having educational (medical and pedagogical) character.
