The article deals with the problems of legal regulation and development trends of the unauthorized construction institution. The forensic law enforcement practice on this category of cases is analysed. According to the research results the author proposes and justifies the possible options of resolution of the mentioned problems and the legislation contradictions.

В статье рассмотрены проблемы правового регулирования и тенденции развития института самовольной постройки. Произведен анализ судебной правоприменительной практики по данной категории дел. По итогам проведенного исследования предлагаются и обосновываются возможные варианты разрешения обозначенных проблем и противоречий законодательства.
