О некоторых проблемах правового режима недвижимости в аспекте реформирования земельного законодательства Российской Федерации

Abstract

The article analyzes some of the latest developments of the Land Code of the Russian Federation in conjunction with the applicable provisions of the Civil Code of the Russian Federation. Particular attention is paid to the emergence of new legal frameworks designed to encourage developers to comply with the terms of construction and holders of buildings and structures to draw title to land occupied by such objects. According to the results of the analysis in general a positive assessment adopted in the Land Code of the Russian Federation amendments is given, however, the analysis stresses the need of further improvement of the rules of the Code.

Анализируются некоторые из последних изменений Земельного кодекса Российской Федерации во взаимосвязи с действующими положениями Гражданского кодекса Российской Федерации. Особое внимание уделено появлению новых механизмов правового регулирования, призванных стимулировать застройщиков соблюдать сроки строительства, а правообладателей зданий и сооружений оформлять права на земельные участки, занятые такими объектами. По результатам проведённого анализа в целом даётся положительная оценка принятым в Земельный кодекс Российской Федерации поправкам, однако подчеркивается необходимость дальнейшего совершенствования норм указанного Кодекса.
