О законодательном определении эвтаназии и ее правовых последствиях

Abstract

The article deals with the problem of legislative definition of euthanasia, the author proposes his own treatment of this category, he comes to the conclusion about inadmissibility of legalization of euthanasia in Russia. When a medic (a person with a higher or specialized secondary medical education) commits euthanasia with the use of official position the author offers to establish higher criminal liability and to qualify a criminal conduct under the point "m" part 2 item 105 of the criminal code of Russian Federation.

В статье исследуется проблема законодательного определения понятия эвтаназии, предлагается авторская трактовка этой категории, делается вывод о недопустимости легализации эвтаназии в России. В случае совершения эвтаназии медицинским работником (лицом, имеющим высшее или среднее специальное медицинское образование) с использованием своего служебного положения предлагается установить повышенную уголовную ответственность и квалифицировать содеянное по п. «м» ч. 2 ст. 105 УК РФ.
