Теоретические аспекты определения понятия дорожно-транспортного преступления

Abstract

Одним из самых распространенных видов неосторожных преступлений являются преступления, связанные с нарушением правил дорожного движения и эксплуатации транспортных средств. Вопросы предупреждения транспортных преступлений по-прежнему остаются актуальными. Однако действующее законодательство не содержит понятия дорожно-транспортного преступления, определяя лишь дорожно-транспортное происшествие. Анализ определения дорожно-транспортного происшествия позволяет сделать вывод, что дорожно-транспортное преступление является более узким по отношению к нему термином.

One of the most common types of rash of crimes are crimes related to violation of traffic rules and operation of vehicles. Questions of prevention transport crimes remain relevant. However, current legislation does not contain the concept of road traffic offenses, defining a traffic accident. Analysis of the definition of a road traffic accident leads to the conclusion that the road traffic offense is narrower towards him term.
