Abstract

Статья посвящена исследованию вопроса о содержании и направлениях уголовно-правовой оценки причинения вреда при нарушении профессиональных обязанностей по русскому праву XIX в. Раскрывается специфика понимания признака противоправности преступления и ее значение для конструирования и применения уголовно-правовых норм, разграничения преступлений и проступков, связанных с нарушением профессиональных функций.

The article is devoted to the question research about content and directions of criminal-law assessment of harm causing at professional functions violation on Russian law of 19th century. The article reveals the understanding specifics of characteristic of illegality of crime and its meaning and offences linked with professional functions violation.
