Abstract

В предлагаемой статье рассмотрены проблемы «вертикального» и «горизонтального» внутригосударственного коллизионного регулирования в правовом комплексе норм о земельных участках в особо охраняемых природных территориях как объектах гражданских прав. Показано, что в исследуемой сфере нарушены все компоненты «горизонтального» согласования разноотраслевых норм. Сделан вывод о том, что пренебрежение национальным коллизионным регулированием как формой межотраслевых связей гражданского права отрицательно сказывается на внешнесистемном единстве цивилистической отрасли права.

This article is devoted to problems of «vertical» and «horizontal» national collisional legal regulation in the legal complex containing the norms on land plots in the specially protected natural areas as objects of civil rights. It is shown that all components of the «horizontal» harmonization of different branch norms violated. It is concluded that the neglect of the national collisional regulation as a form of the interbranch relations of civil law has a negative impact on external system unity of civil law.
