Метод аналогии в толковании норм уголовно-процессуального права (на примере Республики Беларусь)

Abstract

В статья рассматривается как, используя метод аналогии в уголовно-процессуальном праве, правоприменитель уясняет является ли расследуемое деяние уголовным, обеспечивает правильное осуществление правосудия по уголовным делам и защиту субъективных прав и интересов участников процесса. Толкование любой нормы уголовно-процессуального права необходимая предпосылка ее применения, как и необходимое свойство самого процесса применения права. Метод аналогии представляет собой своеобразную форму внедрения процессуального закона в правоприменительную практику, посредством того, что, при помощи толкования, предоставляет возможность полного, всестороннего исследования фактических обстоятельств рассматриваемого дела и поиска сходных существенных признаков рассматриваемых ранее аналогичных фактических обстоятельств.
