In article from the point of view of the historical and legal analysis problems of introduction of criminal penalty in the form of forced labor are considered. Such type of punishment was applied according to the Code of 1903, and in the 1920–1930th years subsequently. Return to this measure of punishment took place in connection with changes of a political situation in the USSR – introduction of the new criminal legislation and reflected a course on a humanization retaliatory the politician. In the 1970th years, on the contrary, the tendency to strengthening of criminal penalty was shown. In the same time during this period considerable experience of application of punishment in idea of forced labor without isolation from society was saved up. According to the author, efficiency of a punitive measure should be considered in a complex from a social and economic situation in the country. Unfortunately, the execution of the punishment in the form of forced labor is postponed until 2017, but it gives the chance for high-quality research of consequences of application of this type of punishment.

В статье с точки зрения историко-правового анализа рассматриваются проблемы введения уголовного наказания в виде принудительных работ. Такой вид наказания применялся в соответствии с Уложением 1903 года, впоследствии в 1920–1930-е годы. Возвращение к данной мере наказания состоялось в связи с изменениями общественно-политической ситуации в СССР – введением нового уголовного законодательства и отражало курс на гуманизацию карательной политики. В 1970-е годы, наоборот, проявлялась тенденция к усилению уголовного наказания. В то же время в этот период был накоплен значительный опыт применения наказания в идее принудительных работ без изоляции от общества. По мнению автора, эффективность наказательной меры следует рассматривать в комплексе с социально-экономической обстановкой в стране. К сожалению, исполнение наказания в виде принудительных работ отложено до 2017 г., но это дает возможность для качественного исследования последствий применения данного вида наказания.
