Abstract

В статье проводится анализ института возобновления уголовных дел ввиду новых и вновь открывшихся обстоятельств. Рассматриваются вопросы сущности и процессуального значения возобновления уголовных дел ввиду новых и вновь открывшихся обстоятельств как самостоятельной стадии российского уголовного процесса. Обосновывается необходимость модернизации законодательства, регламентирующего возобновление уголовных дел ввиду новых и вновь открывшихся обстоятельств.

The article analyzes the institution resumption of criminal cases in view of new and renew circumstances. Issues of the nature and procedure of the restoration of the criminal cases in view of new and renew circumstances as independent under Russian criminal trial are considered. The necessity of modernization of legislation governing the resumption of criminal cases because of new and renew circumstances is based.
