Проблемы методологи формирования категориально-понятийного аппарата юридической науки

Abstract

The article is devoted to the problem of formation of concept framework. General and universal dialectic method of transition from abstract to concrete and then from concrete to abstract is analyzed the roll of logiko-gnoseological procedures “abstract idealization” and “abstraction identification” and the category “concrete” is the formation of categories and legal concepts is considered, that categories and concepts characteristic of concept framework a general theoretic and definite and definite legal sciences.

Статья посвящена проблеме формирования понятийного аппарата юридической науки. Анализируется общий и универсальный диалектический метод восхождения от абстрактного к конкретному и от конкретного к абстрактному, рассматривается роль логико-гносеологических процедур «абстракция-идеализация», «абстракция-отождествления» и категории «конкретное» в формировании категорий и понятий права, обосновывается, что категории и понятия присущи понятийному аппарату как общетеоретических, так и отраслевых юридических наук.
