Экономическая теория и статистика корыстных преступлений

Abstract

В рамках экономической теории проведен анализ выгод и издержек преступника в зависимости от его отношения к риску и величины дохода, получаемого им в легальном секторе экономики. Выводы сравниваются с результатами эмпирических исследований и применяются для обсуждения последних законодательных изменений уголовной ответственности за получение взятки. Показано, что для создания устойчивой тенденции к снижению уровня коррупции в современной России необходимо поднять вероятность наказания правонарушителя, по крайней мере, на порядок.

An analysis of costs and benefits of criminal depending on his attitude to risk and amount of income that he received in the legal economic sector is researched in terms of economic theory. Findings are compared with results of empirical research and applied to discuss recent legislative changes to criminal liability for accepting a bribe. It is shown that for a downward trend in the level of corruption in modern Russia it is necessary to raise the probability of punishment of the criminal at least an order of magnitude.
