Abstract

В статье рассматриваются международно-правовые основы неприкосновенности частной жизни, федеральное законодательство, в том числе Федеральные законы «Об информации, информационных технологиях и о защите информации», «О персональных данных», «О коммерческой тайне» и т. д. В частности, обсуждается вопрос, является ли нарушением частной жизни работников контроль со стороны работодателя за их деятельностью в служебных помещениях посредством просмотра рабочей электронной почты, доступа к просматриваемым сотрудниками вебстраницам в сети Интернет, прослушивания телефонных переговоров сотрудников и т. п.

The article examines the international legal foundations of privacy, the federal laws, including "Concerning information, information technologies and protection of information", "Concerning personal data", "Concerning commercial secrets" and others. In particular, the authors discuss whether the control of employees' activities in the offices by scanning their work e-mails, control of access to web pages viewed by employees, listening of phone conversations and so on is a violation of privacy.
