К вопросу Об административно-правовом характере профессиональной деятельности врача

Abstract

На современном этапе развития медицинской науки и практики все более пристальное внимание уделяется вопросам правового регулирования отношений, возникающих при осуществлении врачебной деятельности. К числу наиболее спорных и противоречивых вопросов в сфере правового регулирования медицинской деятельности относятся вопросы определения отраслевой принадлежности правоотношений, возникающих при оказании врачами квалифицированной медицинской помощи. В статье автор обозначает и тщательно исследует административно-правовые критерии, характеризующие врачебную деятельность. По мнению автора, сферу оказания врачебной помощи гражданам в Российской Федерации следует рассматривать в качестве объекта административно-правового регулирования. Соответственно, врачебную квалифицированную помощь гражданам необходимо признать деятельностью по оказанию государственных услуг, которая регламентирована административно-правовыми нормами и осуществляется под контролем компетентных органов исполнительной власти (Росздравнадзором и его территориальными органами).

At the present stage of development of medical science and practice more and more attention is paid to the legal regulation of carrying out medical activities relations. Among the most contentious and controversial issues arising in the field of legal regulation of medical activity, issues include the definition of industry sector of legal relations arising in the provision of skilled care physicians. The author indicates carefully examines the legal and administrative criteria that characterize medical practice. The author believes that the provision of medical care to citizens of the Russian Federation should be viewed as an object of administrative and legal regulation. Accordingly, qualified medical assistance to the citizens need to recognize the activities of public service, which is regulated by administrative law and is carried out under the supervision of the competent authorities of the executive power (RZN and its territorial bodies).
