Уголовно-правовые риски в сфере исполнения обязательств сторонами государственного и муниципального контракта

Abstract

В статье описаны наиболее типичные уголовно-правовые риски, возникающие в сфере исполнения государственных и муниципальных контрактов на этапе исполнения обязательств со стороны поставщика (подрядчика, исполнителя) по поставке товара, выполнению работ и оказанию услуг, а также на этапе исполнения заказчиком обязанностей по оплате. Предложена авторская классификация указанных уголовно-правовых рисков на риски контроля, риски цели и риски адаптации, а также риски ненадлежащего предпринимательства. Описаны особенности конститутивных признаков составов преступлений, связанных с указанными рисками, и предложены механизмы снижения рисков.

The article deals with the description of typical criminal law risks, arising in the phase of goods, works and services acceptance and in the phase of payment under a governmental and municipal contract. The authors suggest classification of criminal law risks in this sphere into risks of control, risks of aim and risks of adaptation. Moreover, special attention is paid to risks of improper entrepreneurship. The article describes the constituent elements of crimes, concerning these risks and the author's proposals to minimize risks in the management activity of public customers and private consumers, contractors and executors.
