В статье рассматриваются вопросы правового положения юридических лиц, в том числе коммерческих организаций по обновленному Гражданскому кодексу Российской Федерации. Исследуется проблема правоспособности юридического лица, компетенции органов юридического лица и существа юридического лица. Рассматриваются вопросы исполнения гражданских прав обязанностей юридического лица его работниками. Раскрыты основные положения нового Предпринимательского кодекса Республики Казахстан о понятии предпринимательства, субъектах предпринимательства и их видах.
