Призыв как предмет комплексной психолого-лингвистической судебной экспертизы по уголовным делам экстремистской направленности

Abstract

Практика производства уголовных дел по статьям связанным с экстремизмом и экстремистской деятельностью показывает необходимость в определении понятия призыв, его различения с понятиями пропаганда и подстрекательство. Встает вопрос о формировании единого понятийного аппарата, адаптации существующих экспертных инструментов и технологий. Авторами проводится исследования в области мотивации и стимулирования человеческой активности посредством текстов, видеообращений, как ключевого условия рассмотрения объектов экспертизы на предмет содержания в нем психологических, лингвистических признаков. Разрешение данного вопроса позволит осуществить обобщение подходов и обмен современными технологиями в практике выявления и профилактике экстремизма. В статье выделяются признаки и требования к составлению вопросов для экспертов комплексной психолого-лингвистической экспертизы с учетом реалии деятельности судебного эксперта.

The practice of criminal cases under articles connected with extremism and extremist activities has shown the need for definition appeal, distinguishing between the concepts of propaganda and incitement. The question arises about the formation of a unified conceptual framework, adaptation of existing forensic tools and technologies. The authors conducted research in the field of motivation and stimulation of human activity through texts, video messages, as a key analysis object of psychological, linguistic attribute appeal. The resolution of this issue will allow the generalization of approaches and the exchange of modern technologies in the detection and prevention of extremism. The article explores the characteristics and requirements for the preparation of questions for the experts on complex psycho-linguistic expertise taking into account the realities of activity of the expert.
