ПРИМЕНЕНИЕ ТЕОРИИ РАЦИОНАЛЬНОГО ВЫБОРА В УГОЛОВНОМ ПРАВЕ И КРИМИНОЛОГИИ (НА ПРИМЕРЕ ТЕОРЕМЫ КОУЗА)

Abstract

В статье исследуется возможность применения теории рационального выбора в уголовном праве и криминологии на примере теоремы Коуза. Утверждается, что уголовный закон порождает значительные социальные издержки, которые могут быть сокращены, в частности, за счет более эффективного применения норм, регламентирующих примирение преступника с потерпевшим.

The article explores the possibility of rational choice theory in criminal law and criminology on the example of the Coase theorem. It is alleged that the criminal law gives rise to considerable social costs that can be reduced, in particular through better application of the rules governing criminal reconciliation with the victims.
