Актуальность темы обусловлена необходимостью более детального рассмотрения теории и практики реализации мер защиты и обеспечения гарантий соблюдения прав и свобод в рамках чрезвычайного положения. Предмет статьи – специфика чрезвычайного положения как особого правового режима, законным об-разом ограничивающего отдельные права и свободы. Цель заключается в выявлении сущности правового режима чрезвычайного положения как легитимного основания ограничения отдельных прав и свобод человека. В статье указывается, что чрезвычайное положение является вводимым на всей территории РФ или в ее отдельных местностях особым правовым режимом, определяющим деятельность и правовое положение органов государственной власти, органов местного самоуправления, любых юридических лиц, общественных объединений и физических лиц. Как правило, вводится чрезвычайное положение с целью устранения обстоятельств, которые явились основанием для его введения, а также обеспечения защиты конституционного строя РФ и защиты прав и свобод человека. Среди обстоятельств, которые представляют непосредственную угрозу жизни и безопасности населения или конституционному строю РФ, в статье указываются следующие: во-первых, любые попытки изменения насильственным путем конституционного строя, незаконного присвоения (захвата) власти, массовые беспорядки, включая вооруженные мятежи, террористические акты и пр.; во-вторых, чрезвычайные ситуации природного и техногенного характера, в том числе в сфере экологии, включая эпизоотии и эпидемии. Кроме того, отмечается, что для оперативного устранения обстоятельств, которые послужили причиной введения данного правового режима, государство вводит ограничение ряда прав и свобод (ограничивает свободу передвижения, запрещает массовые мероприятия и пр.). В заключение автор приходит к выводу, что меры, реализуемые в рамках особого правового режима чрезвычайного положения, являются обоснованными. The article is devoted to the consideration of the specifics of the state of emergency as a special legal regime that restricts certain rights and freedoms. The relevance of the topic is due to the need for a more detailed consideration of the theory and practice of implementing protection measures and ensuring guarantees for the observance of rights and freedoms in the state of emergency. The purpose of the study is to identify the essence of the legal regime of the state of emergency as a legitimate basis for the restriction of certain human rights and free-doms. The article indicates that a state of emergency is imposed on the entire territory of the Russian Federation or in its individual localities by a special legal regime. This regime determines the activities and legal status of public authorities, local governments, any legal entities and other economic entities, public associations and individuals. As a rule, a state of emergency is introduced in order to eliminate the circumstances that were the basis for its introduction, as well as to ensure the protection of the constitu-tional order of the Russian Federation and the protection of human rights and freedoms.
