Abstract

В статье изучены точки зрения ученых о месте производств в структуре юридического процесса; высказано предположение о том, что в структуру уголовно-исполнительного процесса включаются уголовно-исполнительные производства; впервые указано, что постпенитенциарное пробационное производство является самостоятельным уголовно-исполнительным производством и состоит из стадий и этапов; впервые выделены обязательные (основные) и дополнительные (факультативные) стадии и этапы постпенитенциарного пробационного производства в отношении лиц, освобождающихся или освобожденных из мест лишения свободы; отмечено, что сформулированные предложения могут быть использованы при дальнейшем исследовании научной природы постпенитенциарной пробации в разных отраслях знаний и реализации взаимодействия между субъектами постпенитенциарной пробации и другими заинтересованными лицами (организациями) в целях предупреждения рецидивной преступности. The article examines the point of view of scientists on the place of proceedings in the structure of the legal process; it is suggested that the structure of the criminal enforcement process includes criminal enforcement proceedings; for the first time it has been indicated that post-penitentiary probation proceedings are independent criminal enforcement proceedings and consists of stage and phases; for the first time mandatory (basic) and additional (optional) stages and phases of post-penitentiary proceedings have been highlighted in respect of persons released or released from places of imprisonment; it is noted that the formulated proposals can be used in further scientific research of post-penitentiary probation in various fields of knowledge and implementation of interaction between subjects of post-penitentiary probation and other interested persons (organizations) in order to prevent recidivism.
