Abstract

Анализируя нормы административного законодательства, автор раскрывает характерные особенности специальных технических средств как источников доказательств в производстве по делам об административных правонарушениях и их использования в правоприменительной деятельности в процессе доказывания. Приводится классификация специальных технических средств как источников доказательств в производстве по делам об административных правонарушениях. Вносятся предложения по внесению в КоАП РФ дефинитивных норм, закрепляющих содержание понятий «автоматический режим работы специальных технических средств», «специальные технические средства, имеющие функции фото и киносъемки, видеозаписи». Analyzing the norms of administrative legislation, the author reveals the characteristic features of special technical means as sources of evidence in proceedings on cases of administrative offenses and their use in law enforcement in the process of proving. The classification of special technical means as sources of evidence in proceedings on cases of administrative offenses is given. Proposals are being made to introduce into the Code of Administrative Offenses of the Russian Federation definitive norms that fix the content of the concepts "automatic mode of operation of special technical means", "special technical means having the functions of photographing and filming, video recording".
