В статье проведен комплексный анализ доктрины, судебной и антимонопольной практики, новелл законодательства в сфере поддержки субъектов малого и среднего предпринимательства и самозанятых физических лиц во взаимосвязи с правовыми нормами о специальном налоговом режиме «налог на профессиональный доход», порядке осуществления публичных и корпоративных закупок, защите конкуренции. Делается вывод о двойственном положении самозанятых физических лиц в сфере закупок. Выявлены проблемы личного (индивидуального) участия самозанятых лиц в закупках и их ответственности, влекущие риски для заказчиков. Ставится под сомнение целесообразность поддержки деятельности самозанятых лиц посредством возможности их участия в закупках ввиду несоответствия данной меры поддержки принципам эффективности и рациональности закупок. The article provides a comprehensive analysis of the doctrine, judicial and antimo-nopoly practice, new legislation in the field of support for small and medium-sized businesses and self-employed persons in connection with the legal norms on the special tax regime "professional income tax", the procedure for public and corporate procurement, protection of competition. The conclusion is made about the dual position of self-employed individuals in the field of procurement. The problems of personal (individual) participation of self-employed persons in procurement and their responsibility, entailing risks for customers, are revealed. The expediency of supporting the activities of self-employed persons through the possibility of their participation in procurement is questioned due to the inconsistency of this support measure with the principles of efficiency and rationality of procurement.
