Abstract

В уголовно-процессуальном праве существует ряд основополагающих принципов, к числу которых относится принцип действия уголовно-процессуального закона в пространстве. Он позволяет правоприменителю корректно использовать нормы закона на практике. В данной статье была поставлена задача сравнить нормы закона, касающиеся действия уголовно-процессуального закона в пространстве, закрепленные в Уголовно-процессуальном кодексе Российской Федерации и Уголовно-процессуальном кодексе Федеративной Республики Германия. В результате сравнительного анализа выявлены сходства и различия нормативно-правовых актов, регламентирующих действие уголовно-процессуального закона в пространстве. Это позволило детально изучить некоторые пробелы в этой области в законодательных актах двух стран. There are a number of fundamental principles in criminal procedure law, including the principle of operation of the criminal procedure law in space. It allows the law enforcement officer to correctly use the norms of the law in practice. This article sets the task of comparing the norms of the law concerning the operation of the criminal procedure law in space, enshrined in the Criminal Procedure Code of the Russian Federation and the Criminal Procedure Code of the Federal Republic of Germany. As a result of the comparative analysis, similarities and differences in the normative legal acts governing the operation of the criminal procedure law in space were revealed. This made it possible to study in detail some gaps in this area in the legislative acts of the two countries.
